BPRO KYC Identification Service

1. Scope of Application

Blockchain Propulsion AG, Baarerstrasse 14, 6300 Zug, Switzerland ("BPRO" or "we"), offers a service for the identification of natural persons ("Identification Service"). The use of the Identification Service is subject to following terms and conditions ("Terms and Conditions") between BPRO and you ("End User", "you").

2. Contracting Parties

The Identification Service is designed to identify the End Users and to verify their official identification documents ("Identification Documents") against third parties with whom you intend to do business or have a business relationship, such as a bank, insurance company, price comparison portal, mail provider or signature provider ("Partner"). As a rule, these are obliged by law (in particular, the Anti-Money Laundering Act and the Federal Act on Electronic Signatures) to establish the identity of End Users in order to enter into a business relationship with the End User. In this respect, BPRO acts as independent Identification Service provider and only provides the Identification Service and verification of Identification Documents. BPRO does not make any transactions or payments between you and the Partner, nor does it act as an agent or messenger for the Partner. Services provided by the Partner are governed solely by the terms and conditions agreed between you and the Partner. BPRO uses the licensed identification software from IDnow GmbH, Auenstrasse 100, 80469 Germany, which complies with FINMA regulations and the provisions of the Data Protection and Anti-Money Laundering Act (AMLA). BPRO offers the Identification Service both webpage-based via PC and through mobile device. Depending on the integration by our partners, website-based solutions can be accessed via various top-level, sub-domains, and aliases of these domains.

3. Availability of Service

BPRO strives to provide reliable Identification Services throughout the entire operational lifecycle of the system. Operating hours of the Video Identification and eSign service is from Monday to Saturday (07:00 - 22:00 CET), excluding maintenance windows. Operating time of the AutoIdent is from Monday to Sunday (00:00 - 24:00 CET). Maintenance can be performed daily from 00:00 to 06:00 CET. Maintenance can also be performed during operating hours if maintenance work is urgently required to maintain operation ("Maintenance Window").

4. Identification Process

The Identification Service is provided either by means of video telephony between End User and an BPRO agent or through a process guided by the system. As part of such a process, a BPRO agent or the system verifies the identity of the End User against the Identification Documents, depending on Partner specifications and regulatory requirements. The individual steps of the identification process are as follows:

  1. Participation in Identification Service requires a transaction number assigned to the respective End User, which is already known to BPRO or is communicated to the End User in advance by BPRO or the Partner.

  2. The End User must then enter personal data (e.g. first and last name, date of birth, nationality, ID number, issuing authority, ID number, address) in an input interface, which is suitable for verifying his identity. Alternatively, this personal data is transmitted to BPRO by the Partner.

  3. The BPRO agent or system compares the data from step 2 with data from the End User's Identification Document (identity card, passport, driver's license), such as first and last name, date of birth, nationality, ID number, etc. It may also be necessary for the BPRO agent or the system to take photographs of the end user and his ID document, record the data from the ID document and make an audio or video recording. The type and scope of the data collected depends on the requirements of the Partner in question and the legal requirements to be observed by the Partner.   4. Depending on Partner's requirements, the End User will be asked to keep additional documents (e.g. registration certificates, invoices from electricity/gas/telecommunications providers, salary statements, certificates of enrolment) ("Additional Documents") or have them photographed by the BPRO agent.

  5. The information contained in the documents described in step 4 will also be collected and compared by a BPRO agent or the system with the data provided in steps 2 and 3 to the extent necessary to identify the End User.

  6. During the video identification process, BPRO will send the End User an e-mail or SMS with a centrally generated transaction number ("TAN") associated with the identification process. During the video call, the End User returns the TAN to BPRO upon request by entering it in a designated field. BPRO checks the correct entry by the system and by a BPRO agent.

  7. BPRO will not be able to determine End User’s identification unless all documentation required for verification, as part of the identification process by BPRO, is provided by the End User.

  8. BPRO transmits data collected during the identification process (typically a photograph of the front and back of the Identification Document, a photograph of the End User, the data collected from the Identification Document and an audio and/or video recording of the conversation for the duration of the video call) to the Partner to identify the End User. Thereafter, BPRO deletes the personal data on its servers within 90 days at the latest.


5. User Relationship

By clicking on the button "Start Identification" the End User offers to BPRO to conclude a contract in accordance with these Terms & Conditions. The contract is concluded by the actual execution of the Identification Service. Only natural persons may use the Identification Service.


6. User Obligations

The End User is obliged to provide BPRO with all documents required for the provision of the Identification Service in accordance with clause 4 of these Terms & Conditions and to enter all information in the data fields provided truthfully. To use the Identification Service, a suitable terminal device (e.g. a computer, smartphone, or tablet) and Internet connection are required. It is the End User's responsibility to ensure the performance and compatibility of the respective device. The End User must keep all data provided to him/her by BPRO (e.g. transaction number and TAN) secret and protect it against use by unauthorized third parties. The End User shall inform BPRO immediately in case of suspicion of unauthorized use of his data. Any charges for a data connection to the Internet required for the use of the Identification Service shall be borne by the End User.


7. Liability

The liability of BPRO, it’s legal representatives and vicarious agents is excluded to the fullest extent permitted by law. Liability under the Product Liability Act remains unaffected.


8. Data Protection

We collect, process, and use your personal data in accordance with the applicable data protection regulations. You will find details of this in our Privacy Policy declaration.


9. Final Provisions

Unless otherwise agreed, End Users may submit all declarations by e-mail or letter to BPRO:

All identifications made through BPRO applications are subject to these Terms and Conditions exclusively in the relationship between BPRO and the End User. The End User may only offset against claims of BPRO with undisputed or legally established counterclaims. Swiss Law applies.
